Conrad Murray Not Expected To Serve Full Four Years
Legal expert Mike Cavalluzzi tells MTV News he isn’t surprised by sentence but doesn’t think it’s justified.

Though he dodged a potential four-year prison term, former Michael Jackson physician Conrad Murray was sentenced to an equal amount of time in Los Angeles County Jail on Tuesday (November 29) in the death of the pop singer.
But the same overcrowding problems that spared the cardiologist from doing time in a federal pen might also save him from serving his entire sentence in county as well. Shortly after the sentence was handed down by Los Angeles Superior Court Judge Michael Pastor, Los Angeles Sheriff spokesman Steve Whitmore told E! News that Murray would likely end up serving “a little less than two years.” Due to overcrowding, most county jail sentences are immediately cut in half, and given the 46 days credit Murray has already been given, he is looking at even less than that.

Murray’s lawyers said afterward that they believed the sentence was unnecessarily long. “Yes, of course [Judge Pastor] was harsh. He gave the stiffest penalty he was entitled to give under the law,” Murray’s attorney, J. Michael Flanagan, told reporters. “He was openly hostile. … [Murray has] led 56 years of exemplary life. He was really dreading [sentencing]. I think anybody would dread going into it. He’s an honorable man, and he’ll get through this. The family is suffering more than Dr. Murray is. … Dr. Murray is the provider in that family.”
Pastor had leeway in the sentencing, with options ranging from probation to the full sentence, but in a lengthy ruling from the bench, he said Murray’s lack of remorse and negligent behavior called for the highest possible penalty. “He is and remains dangerous … the request of probation is denied, the court imposes the high term of four years imprisonment in this case,” Pastor said during the 90-plus-minute hearing.
Los Angeles-based criminal defense attorney Mike Cavalluzzi told MTV News that he wasn’t surprised by the sentencing but that he didn’t believe it was justified. Cavalluzzi said Pastor had incentive to give the full sentence because of the prominence of Jackson and his family and to create the perception that he is tough on crime. “He gets that perception by sentencing him to the max while not having to surrender the defendant to the full sentence,” said Cavalluzzi, who was not involved in the case. “He gets the self-satisfaction of being perceived as being tough on crime and making the Jackson family happy, but I don’t think it was a fair sentence.”
Cavalluzzi said when deciding prison versus probation, judges have to look at someone’s criminal history and whether a person is likely to complete the terms of their probation, which he believes Murray would. “I’m not seeing aggravating factors here, and I think it was just a chapter in [Murray's] life and he does not have a history of being a mercenary doctor always after money, but of being a good, responsible doctor who was seduced by the celebrity and money that Jackson offered,” he said.
As to why Pastor gave such a dramatic, lengthy explanation for why he was sentencing Murray to the max, Cavalluzzi said the judge has to have a justification for his actions in the public record. “Because he doesn’t have the discretion to give a high prison term, [Pastor] has to justify his sentence in the record and have very specific reasons for it. I don’t think there’s any way that anyone truly believes that from this day forward Dr. Murray truly represents a threat to society. That’s just ludicrous.”
And while he doesn’t agree with the four-year term, Cavalluzzi said the high-profile nature of the case and the glare of the media could have played into the sentence. “It probably gives [Jackson's family] great comfort to have someone to blame,” he said. “‘If not for this awful man, my son, brother, father would be alive.’ But it’s not fair to do that and it feels like a capitulating judgment in favor of feeding the emotional needs of the family.”
Upon leaving the courthouse, Michael’s brother Jermaine, when asked if the four-year sentence was enough, shook his head and said, “No.” Mother Katherine Jackson told local TV station KTLA, “Four years is not enough for someone’s life. It won’t bring him back. But at least he got the maximum, and I thought the judge was very, very fair.”
The prosecution, however, was satisfied with the ruling.
“We’re pleased. That’s what we thought was appropriate. The judge obviously agreed with us,” deputy district attorney David Walgren said. “It was our position that it was not a simple, one-time mistake; it was a series of mistakes culminating in the abandonment of Michael Jackson when he died … the judge agreed with that sentiment. A brother and a son and a family member was killed, and whatever the sentence may be, the family of the victim deserves justice. And we did everything to bring them that justice.”
As for how much time Murray will spend locked up, Cavalluzzi said it is likely to be less than two years and, frankly, he predicted, the doctor could be out even sooner than that. “He might be eligible for house arrest very quickly,” he said.

Miranda Kerr’s Big Apple Family Funday with Flynn
Drawing an end to the Thanksgiving holiday weekend, Miranda Kerr enjoyed a little precious family time in New York City on Sunday (November 27).

Having clearly moved away from her innocent “Hannah Montana” days, Miley Cyrus is seen in a new video proclaiming herself as a “stoner”.
The singer/actress made the statement during her 19th birthday bash at Beacher’s Madhouse in the Roosevelt Hotel in Los Angeles last week (November 23) – with the happenings all being caught on camera.
Joined by gal pal Kelly Osbourne for the festivities, Miley is shown looking at her birthday cake crafted in the shape of reggae legend/marijuana advocate Bob Marley as she said, “This is amazing. You know you’re a stoner when your friends make you a ‘Bob Miley’ cake. You know you smoke way too much f??ing weed.”
To this, Miss Osbourne chimed in to say, ?I thought salvia was your problem.?
Quickly taking over headlines on the web, Kelly has since taken to Twitter to claim that the whole back and forth was in jest, as she tweeted, ?let me make something very clear after @MileyCyrus salvia incident we started calling her bob miley as a JOKE! the cake was also A JOKE! it makes me sick that @MileyCyrus so called ?friends? would sell her out and lead people 2 believe she is someone that she is not!?

“Breaking Dawn” Tops the Thanksgiving Weekend Box Office
Heading into the Thanksgiving holiday, “The Twilight Saga: Breaking Dawn – Part 1″ continued to lock up first place at the box office to begin the long weekend of November 23-27, 2011.
The Robert Pattinson, Kristen Stewart and Taylor Lautner starring vampire picture took in $12.5 million on Wednesday, $7.8 million on Thursday and $17 million on Friday with a forecast of $62.3 million over the five-day weekend run.
Settling for the runner-up slot was a cinema newcomer, as the family friendly picture “The Muppets” brought in $6.6 million on opening day with an anticipated Thanksgiving weekend grand total projected at a respectable $43.5 million.
With quite the spread being found between second and third, the animated movie “Happy Feet Two” slipped a spot from last week’s runner-up status with $10.4 million from Wednesday through Friday for an estimated holiday weekend outlook set at $18 million.
Rounding out the top ten in projected five-day earnings at the box office are “Arthur Christmas” ($16.5 million), “Hugo” ($15 million), “Jack & Jill” ($14 million), “Immortals” ($13.3 million), “Puss In Boots” ($11.5 million), “Tower Heist” ($10 million) and “The Descendants” ($9 million).

Drake’s Take Care Tops Billboard
Michael Bublé, Adele round out the top three on the albums chart.

Drake has a lot to be thankful for this week. His sophomore LP, Take Care, officially debuts in the #1 spot on the Billboard 200 albums chart Wednesday (November 23). “I can’t even find the words to express my appreciation. … ‘Thank you and I owe you’ is all that comes to mind … truly,” Drizzy tweeted Tuesday night in reaction to the news.
SoundScan tallies that Drizzy pushed over 631,000 copies of the album, which was released on November 15. It was forecasted that the Young Money soldier would sell as many as 700,000 copies, but he fell just south of that, not that he or anyone at his label is sweating over sales. YM CEO Lil Wayne told MTV News that he was more concerned with how Take Care is received critically.
“Pardon me for sounding however I sound with this statement, but we rich as sh–, so numbers and record sales, that doesn’t matter to none of us,” Wayne said. “We just want to get a perfect point across, a swell opinion across.”
Michael Bublé‘s Christmas lands at #2, leading the pack of other holiday albums including Justin Bieber‘s Under the Mistletoe (#5) and Glee: The Music, the Christmas Album, Vol. 2 (#6). Adele‘s 21 continues its reign, moving another 112,000 units this week, easily putting the U.K. singer in the #3 position. Andrea Bocelli‘s Concerto: One Night in Central Park debuts in the #4 slot, while Now 40, Coldplay‘s Mylo Xyloto, the “Twilight Saga: Breaking Dawn – Part 1″ soundtrack and Susan Boyle‘s Someone to Watch Over Me round out the top 10.
Childish Gambino also scores a huge win in his first week, selling 52,000 copies of Camp, but last week’s top album, Blue Slide Park by Mac Miller, slides down to #24, selling another 25,000 copies independently.

‘Hugo’: The Reviews Are In!
Most critics praise film’s visuals and performances, although some take issue with its length.

We’re big “Hugo” fans here in the MTV Newsroom, as we make clear over at Movies Blog, calling Martin Scorsese’s 3-D film a “love letter to cinema” and “like nothing you’ve ever seen from the Oscar-winning filmmaker before.”
We’re not the only ones raving about it. Critics are celebrating the movie’s bold visual style and strong performances. The only issue anyone seems to have with “Hugo” is that there’s just too much of it: The story — following the young orphan Hugo’s (Asa Butterfield) adventures in a 1930s Parisian metro station, his battles with the station inspector (Sacha Baron Cohen) and his friendship with a girl (Chloë Grace Moretz) also living in the station who is being raised by film pioneer Georges Méliès (Ben Kingsley) — chugs forward too slowly before finally springing to life. The Story ” ‘Hugo’ is the tale of a boy, one of fiction’s sentimental orphans, and the world he invents, yet, unsurprisingly, its most heartfelt passages are about Méliès. The old filmmaker is as broken and in need of revival as the automaton, and while you can guess what happens, it’s the getting there — how the clock is wound — that surprises and often delights. Waves of melancholy wash over the story and keep the treacle at bay, as do the spasms of broad comedy, much of it nimbly executed by Mr. Baron Cohen.” — Manohla Dargis, The New York Times

The Final Word “[T]he story — period details and mysteries notwithstanding — is too slight to support this length. Yelawolf Promises ‘Let’s Roll’ Video Will Be ‘Magic’

Yelawolf might rep Gadsden, Alabama, to the fullest, but for his next music video, Catfish Billy takes a pilgrimage to hip-hop’s birthplace. For “Let’s Roll,” the next single off his debut LP, Radioactive, Yela hooks up with Kid Rock and hip-hop’s inventor DJ Kool Herc for a ride through the Bronx, New York.
“We had the godfather, Kool Herc, come out and do a cameo — it’s pretty incredible,” Yela told MTV News while on set last week. “The director had the brilliant idea of bringing us to the Bronx, the home of hip-hop, where it was born, and it just made it mean so much more to me. I was like, ‘Ahh, that’s perfect.’ ”
While coming up in the rap game, Wolf has differentiated himself, playing up not only his southern roots, but the fact that he’s a white rapper who at times looks more punk rock than hip-hop. But being from Gadsden doesn’t make him any less authentic. In fact, in the “Let’s Roll” clip, Wolf brings a trailer-park vibe to the Boogie Down Bronx.
“For me, being from Alabama, what hip-hop has given to me, bringing it back here and the blessing of it and just having Kool Herc out here, it’s magic,” Yela reflected.
When it’s all said and done, Yelawolf expects the video will help define his career. “It’s just one of those days that things came together the way they came together, and it’ll be a pivotal video in my career,” he said. “I know it’s gonna really open up a huge door and open a lot of people up to the music.”

Justin Bieber Accuser Will Submit Baby For DNA Test
Mariah Yeater’s lawyer in paternity case says that while lawsuit has been dropped, negotiations for settlement are ongoing.

Justin Bieber reportedly took a DNA test Friday in response to the paternity case brought against him by Mariah Yeater, a 20-year-old California woman alleging the singer fathered her 4-month-old son, and now Yeater’s attorney tells TMZ his client will submit her baby for testing.
Late last month, Yeater filed a lawsuit claiming she became pregnant by Bieber during a backstage encounter following his October 25, 2010, concert at the Los Angeles Staples Center. Yeater withdrew her paternity suit a few weeks later and was dropped as a client by her initial legal team in mid-November. She went on to hire new counsel, led by Chicago-based attorney Jeffrey Leving, who told MTV News that while the suit had been dropped, negotiations for a settlement were ongoing.
Bieber’s legal team vehemently denies the allegations and has stated from the get-go that it might pursue legal action to protect the pop star from further false claims. “As we’ve said from the beginning, it’s sad that someone would fabricate such a malicious, defamatory and demonstrably false claim,” Bieber’s spokesman, Matthew Hiltzik, said in a statement. “We’ll continue to consider all of our options to protect Justin.”
What Are Bieber’s Legal Options Now That Yeater Has Dropped Her Suit? After reports surfaced that Bieber took a DNA test in New Jersey, TMZ reported Yeater was deliberately avoiding having her child tested because she knew the results would serve as evidence against her, should Bieber’s team file suit for defamation or abuse of the legal process. Her lawyer is now dispelling that notion, telling the gossip site that his client “can’t wait” to submit her young son for testing.
Leving, however, claimed he has a problem with the DNA test Bieber reportedly submitted because a member of his team was not present when it was administered. The lawyer said he has been in touch with Bieber’s legal counsel, headed by Howard Weitzman, and hopes both teams can reach an agreement on DNA-testing protocol.
Bieber has maintained a positive attitude throughout the ordeal. He has not altered the promotional tour for his holiday album, Under the Mistletoe, including a recent performance at the American Music Awards and on the “Today” show, and told MTV News last week at the Pencils of Promise charity event that he’s doing “great.”
Earlier that day, he spoke of the paternity case briefly with New York’s Z100 radio station, saying, “As far as the whole baby situation, it’s unfortunate that it had to happen like that. People make false accusations, but things happen in this industry, and you have to keep your head high and be positive.”

It’s known for causing mass hysteria among its fans, however several reports are faulting “The Twilight Saga: Breaking Dawn – Part 1″ for causing a different reaction from audience members this time around – seizures.
According to reports, Brandon Gephart, a man from California, had to be rushed to the emergency room after falling ill while watching Bella’s much talked about birth scene.
While viewing the ultra-gory blood-filled sequence – which features sudden bursts on light – Brandon began “convulsing, snorting, trying to breathe.”
“I didn?t really remember what happened after that I think I blacked out. According to her [his girlfriend, Kelly Bauman], I was shaking and mumbling different noises,” Gephart told ABC News.
Looking as if the problem could go wide-spread, another Twi-hard, who has asked to remain unnamed, told press he also experienced similar issues when watching the clip. The film’s production company, Summit Entertainment, has yet to comment on the incidents.

Drake’s Take Care Tops Billboard
Michael Bublé, Adele round out the top three on the albums chart.

Drake has a lot to be thankful for this week. His sophomore LP, Take Care, officially debuts in the #1 spot on the Billboard 200 albums chart Wednesday (November 23). “I can’t even find the words to express my appreciation. … ‘Thank you and I owe you’ is all that comes to mind … truly,” Drizzy tweeted Tuesday night in reaction to the news.
SoundScan tallies that Drizzy pushed over 631,000 copies of the album, which was released on November 15. It was forecasted that the Young Money soldier would sell as many as 700,000 copies, but he fell just south of that, not that he or anyone at his label is sweating over sales. YM CEO Lil Wayne told MTV News that he was more concerned with how Take Care is received critically.
“Pardon me for sounding however I sound with this statement, but we rich as sh–, so numbers and record sales, that doesn’t matter to none of us,” Wayne said. “We just want to get a perfect point across, a swell opinion across.”
Michael Bublé‘s Christmas lands at #2, leading the pack of other holiday albums including Justin Bieber‘s Under the Mistletoe (#5) and Glee: The Music, the Christmas Album, Vol. 2 (#6). Adele‘s 21 continues its reign, moving another 112,000 units this week, easily putting the U.K. singer in the #3 position. Andrea Bocelli‘s Concerto: One Night in Central Park debuts in the #4 slot, while Now 40, Coldplay‘s Mylo Xyloto, the “Twilight Saga: Breaking Dawn – Part 1″ soundtrack and Susan Boyle‘s Someone to Watch Over Me round out the top 10.
Childish Gambino also scores a huge win in his first week, selling 52,000 copies of Camp, but last week’s top album, Blue Slide Park by Mac Miller, slides down to #24, selling another 25,000 copies independently.
